PERSONAL TRAINING SERVICE AGREEMENT
This Agreement, by and between But I’m Strong, LLC (also hereinafter referred to as “BIS” or “Trainer”) and Cheryl Rozier (“Client”) is made October 31, 2026.
The parties hereby agree that the following terms and conditions shall govern Trainer’s provision of personal training services to Client:
WHEREAS, Trainer agrees to provide specifically tailored Virtual Personal Training Services (also hereinafter referred to as “VPTS”) to Client based on an assessment of Client’s physical fitness goals and needs, including customized independent programs, live virtual sessions, or both; and
WHEREAS, Client wishes to receive specifically tailored VPTS from Trainer.
NOW THEREFORE, in consideration of the terms and conditions set forth below, the Parties agree as follows:
Rates & Payments:
Trainer agrees to provide a package of Virtual Personal Training Session(s) to Client in exchange for payment. Client agrees to pay fee in full within 7 days of the date of this Agreement and prior to Client’s first virtual consultation with Trainer.
Client’s purchased four (4) live virtual training sessions of thirty (30) minutes each, at $55 per session, for a total of $220. Payment status: PAID IN FULL.
Additional services or sessions outside the purchased package require separate agreement and payment.
Scheduling & Term:
Prior to receiving the Program, Client must schedule a virtual consultation with Trainer to discuss Client’s specific fitness level and fitness goals. Consultation with Trainer can be scheduled either directly with Trainer or via the BIS online Portal, on a “first come first serve” basis immediately after submission of payment in full for the Program. Trainer will release any purchased customized Program to Client within 5 business days of the initial consultation. In order to obtain the most desired results, any customized Program must be completed within its specified time frame.
Purchased live virtual training sessions must be used within twelve (12) months of purchase, by October 31, 2027. Unused sessions expire without refund or extension except as required by law or expressly approved by BIS. Pauses, freezes, and extensions are subject to BIS discretion, except as required by law.
Cancellation Policy:
It is the Client’s sole responsibility to schedule the initial virtual consultation with Trainer either directly with the Trainer, or via the online portal in order to receive any purchased Program. Client’s failure to do so does not relieve them of their payment obligations, subject to applicable law. Trainer’s failure to provide Client with a purchased customized program in accordance herein will result in Client’s ability to cancel and receive a full refund. Once a customized Program is issued to Client, it is NON-REFUNDABLE AND NON-TRANSFERABLE, except as required by law.
For live sessions, Client must give at least twelve (12) hours’ notice to cancel or reschedule. Late cancellations and no-shows count as completed sessions. Timely cancellations may be rescheduled subject to Trainer availability and package expiration. BIS may waive the requirement for sudden illness, medical emergencies, or exceptional circumstances at its discretion. If Trainer cancels, Client may reschedule without penalty.
BIS may suspend or discontinue services for nonpayment, misconduct, or safety concerns. Refunds on early termination, including where BIS cannot provide purchased services, remain subject to applicable law; no blanket forfeiture is intended where prohibited.
Commitments and Responsibilities:
a) Client’s Responsibilities. Client is responsible to promptly and fully disclose to Trainer any injury, discomfort or pain arising from or during exercise, limitations or any other condition or impairment which may have a deleterious effect on or be impacted by the Program so that Trainer may accommodate Client and substitute another exercise or training regimen. Client shall promptly notify Trainer if, during the course of training, Client’s medications, condition, or medical limitations should change. Client further promises to not be under the influence of non-prescription drugs, prescription drugs that may impair Client’s ability to exercise, or alcohol, at any time during the Program. Client is responsible for a safe exercise space and appropriate condition and use of personal equipment.
b) Trainer’s Responsibilities. Trainer represents that they will exercise judgement and care in suggesting exercises, fitness and nutrition guidance that Trainer believes most suitable and focused on the achievement of the Client’s short and long term goals. Trainer will appropriately track Client’s exercise progress, using both objective and subjective measures, and share this information with Client at regular intervals during VPTS. Trainer’s decision to discontinue training because of any condition which in their opinion presents an adverse risk or threat to the health or safety of the Client shall be conclusive.
BIS provides ongoing support for exercise questions, progress, and program implementation, responding within twenty-four (24) hours, including weekends and holidays. This is not emergency monitoring. Program adjustments are subject to BIS discretion; unlimited adjustments are not promised.
Attire:
Client must wear comfortable workout attire, including, but not limited to, clean tee or athletic shirts, shorts, tights, sweats, tracksuits and/or similar exercise attire, that are comfortable and facilitate ease of movement. Client shall use appropriate footwear and maintain sufficient safe exercise space.
Severability:
If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Waiver:
The failure of either Party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to enforce any provision of this Agreement.
Choice of Law:
This Agreement shall be governed by the laws of the State of New York.
Client Training Release:
Client must execute the separate BIS Client Training Release before participating in training activities. That release is separate from this Agreement.
